§1. General information

Entry into the prize competition 30 Years of DTM Retro Game 2018 is only possible on the basis of these terms and conditions of entry.

§2. Competition organizer

The organizer of this competition is Daimler AG, Mercedesstraße 137, 70327 Stuttgart.

§3. Participation

All natural, legally competent persons aged 18 years or over - including employees of Daimler AG and its subsidiaries - may take part. By participating, contestants give their consent to their names and/or pictures (free from the rights of third parties, originator need not be named) being published on the internet/on social media sites run by Daimler AG in the event of them winning. Participation is only possible during the time period stated in the competition description. Any recourse to legal action is excluded.

§4. Competition modalities

The Mercedes-AMG DTM Retro Game Competition will be staged parallel to the 2018 DTM season. For every day that you play and register to play with your email address, you are automatically entered into a prize drawing at the end of September. The names of three people, along with a reasonable number of reserve list names, will be drawn at random from all participants.

§5. Prizes

The first place winner can look forward to two tickets to the Mercedes-AMG VIP area at the DTM 2018 end-of-season finale at the Hockenheimring, taking place on the weekend of 12.-14.10.2018 (winners must make their own travel arrangements); a 'meet and greet' with a racing legend; as well as being chauffeured around the Hockenheimring in a genuine Mercedes-AMG C63 DTM racing taxi. The second place winner will receive two tickets to the Mercedes-AMG VIP area at the DTM 2018 end-of-season finale at the Hockenheimring, taking place on the weekend of 12.-14.10.2018 (winners must make their own travel arrangements). The third place winner will receive a ticket for a Mercedes-Benz Driving Event. Where multiple correct entries are received, the winner will be decided by a draw, with legal proceedings excluded. There can be no (cash) substitute offered to the prize. The winner will be notified by email. If the winner does not respond to notification of the win within 4 weeks, the prize lapses and no substitute is offered. The next person on the list moves up. The prize may not be transferred to a third party.

§6. Liability

Claims against the organizer in connection with the competition are, to the extent permitted by the law and irrespective of the legal basis, precluded - unless the organizer is claimed to have violated, through willful intent or gross negligence, his/her legal obligations. The organizer is also not liable for damages claimed to result from non-availability of the competition website in the event of technical malfunctions and events beyond the organizer's control or in the event of hacking attacks by third-parties. The organizer will, however, do everything reasonably possible to ensure the reliability and proper functioning of the competition website. The organizer accepts no liability for ensuring that the competition website will function correctly on participants' computers.

§7. Data protection

The organizer is collecting and processing the personal data of participants solely for the purposes of managing the competition.

§8. Place of jurisdiction / applicable law

Only German law shall apply to all aspects of this competition. Insofar as is permitted by law, the place of jurisdiction is set as Stuttgart, the location of the organizer's headquarters. Provided that the competition entrant does not have a general place of jurisdiction in Germany or moves abroad after entering the competition, the place of jurisdiction shall be agreed as the location of the organizer's headquarters.

§9. Selection process

The winners are selected using a random generator. Their names will be published - see above. The drawing will be documented. Any recourse to legal action is excluded.

§11. Severability clause

Should any of these terms and conditions of entry be or become ineffective or unenforceable in full or in part, this will not affect the validity of the other provisions of the terms and conditions of entry. The invalid term will be replaced with an appropriate and legally admissible provision that most closely accords with the meaning and commercial purpose striven for in the original term. The same applies in the event of an loophole to these terms and conditions of entry.
